Read the TOS

An affiliate program's Terms of Service (TOS) - also know as Terms of Agreement - is a contract between publisher and advertiser, thus, shall not be ignored.
By definition a contract contains the liabilities and rights of both parties. So when you sign up for an affiliate program make you read through the terms. Knowing general details, such as the State by which the contract is governed or the confidentiality clauses will not only make things clear but will also make you know and understand the company you are about to work with a lot better. To see deeper inside you might want to read the company's privacy policy as well.
Avoid programs where CAN-SPAM rules and restrictions on publishing explicit materials are not enforced. It's not worth getting into the kind of legal responsibilities that could, well, maybe even get you in jail.
Other areas to look for include limitation of liability, termination conditions, dispute resolution terms and payment-related issues.
